These Terms & Conditions (“Terms”) govern participation in the Sparq “Bid & Win” auction (the “Auction”), a promotional online auction operated by Nuvo Aeon Diamond & Jewellery Private Limited (“Nuvo Aeon”, “we”, “us”, or “our”) under its brand “Sparq”. By placing a bid, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not place a bid.
1. The Auction & the Item
1.1 Each Auction offers a single item of jewellery (the “Item”) for a fixed duration. The Item, its opening price, its Maximum Retail Price (“MRP”), bid increment, and Auction duration are stated on the Auction page for that Item and form part of these Terms.
1.2 The Item shown on the Auction page at any time is illustrative of the specific piece then on offer. Items change from Auction to Auction. The Item description, images, materials, weight, and specifications published on the live Auction page for the current Item prevail over any sample, archived, or promotional depiction.
1.3 The Item is a genuine Sparq product. Minor variation in colour, finish, or stone characteristics inherent to lab-grown diamond and handcrafted jewellery does not constitute a defect.
1.4 The number of participants is unlimited. Any eligible person may place any number of bids during the Auction period.ct with us digitally.
2. Eligibility
2.1 You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
2.2 You must provide a genuine name and a valid, reachable mobile phone number at the time of bidding. Bids placed with false, incomplete, or unreachable contact details may be disqualified at our sole discretion.
2.3 Employees of Nuvo Aeon and their immediate family members are not permitted to bid.
3. How Bidding Works
3.1 Bidding opens at the stated opening price and rises only in the stated increment (or whole multiples of it). A bid must exceed the current highest bid by at least one increment to be accepted.
3.2 Only the current highest bid and the name of the leading bidder are displayed. Other bid amounts and bidder details are not shown publicly.
3.3 Being outbid does not remove your right to bid again. You may raise your bid as many times as you wish while the Auction is live.
3.4 A bid, once placed and accepted, is final, binding, and cannot be withdrawn, reduced, or cancelled. Placing a bid is a genuine, irrevocable offer to purchase the Item at that amount plus applicable shipping if you are ultimately the confirmed winner.
3.5 We may reject, reverse, or disregard any bid that we reasonably believe to be fraudulent, automated, manipulative, placed in error, in bad faith, or in breach of these Terms, without notice or liability.
4. How the Auction Closes
4.1 The Auction closes on the earlier of: (a) expiry of the stated Auction duration; or (b) the moment any bid reaches the Item’s MRP.
4.2 MRP ceiling. If a bid reaches the MRP, that bid is automatically capped at the MRP, the Auction closes immediately, and the bidder who placed it is declared the winner at the MRP. No bid above the MRP is possible.
4.3 The Auction duration is fixed. Bids placed in the final seconds do not extend the closing time. The timer is not reset or lengthened by late activity.
4.4 The winner is the participant holding the highest accepted bid at the moment of closing. Our records of bids and timing are final and conclusive in the event of any dispute.
5. Winning, Payment & the Purchase Window
5.1 The winner will be notified using the contact details provided at bidding. The winner must complete purchase on the Sparq website within twelve (12) hours of the Auction closing (the “Purchase Window”).
5.2 The amount payable is the winning bid amount plus a flat shipping charge of ₹100, together with any applicable taxes as shown at checkout.
5.3 Time is of the essence. The Purchase Window runs from the moment of Auction close, whether or not the winner has read the notification. It is the winner’s responsibility to provide reachable contact details and to complete payment in time.
5.4 A win is confirmed only upon successful receipt of full payment within the Purchase Window. Until then, no title, reservation, or entitlement to the Item passes to any bidder.
6. If the Winner Does Not Pay (Rollover)
6.1 If the leading winner does not complete payment within their Purchase Window, their right to the Item lapses automatically and the offer rolls over to the next-highest accepted bidder.
6.2 The next bidder is offered the Item at their own bid price (plus ₹100
shipping and applicable taxes), and is given a fresh 12-hour Purchase Window from the time they are notified.
6.3 This rollover repeats down the order of bids — next-highest to lowest — until the Item is purchased or no eligible bidder remains.
6.4 A winner who does not pay simply forfeits the Item. There is no monetary penalty for non-payment, and forfeiting does not by itself bar the bidder from future Auctions. This does not limit our rights under Clause 3.5 or Clause 10 in cases of abuse or manipulation.
6.5 If no bidder completes purchase, the Item is withdrawn and no sale occurs. We are under no obligation to re-offer, re-auction, or sell the Item to any participant.
7. Returns, Warranty & Buyback
7.1 An Item purchased through the Auction carries the same warranty, returns, buyback, and exchange entitlements as a standard Sparq purchase, as set out in the applicable Sparq policies in force at the time of purchase.
7.2 Winner-initiated cancellation: a confirmed winner who has paid but wishes to cancel is entitled to a full refund with no penalty, in accordance with the standard Sparq return / cancellation policy and timelines.
7.3 Refunds are made to the original payment method within the timelines stated in the standard Sparq refund policy. The ₹100 shipping charge is refunded where the standard policy so provides.
8. Pricing, Taxes & Delivery
8.1 All prices are in Indian Rupees (₹). The winning bid is exclusive of the ₹100 shipping charge and of applicable taxes, which are added at checkout.
8.2 Delivery is to the address entered by the winner at checkout, within the timelines stated in the standard Sparq shipping policy. We are not responsible for delays caused by incorrect addresses or courier or force-majeure events.
9. Fair Play & Prohibited Conduct
You must not, and must not attempt to:
- Place bids through bots, scripts, or any automated means;
- Use multiple names or numbers, or coordinate with others, to manipulate bidding, inflate prices, or shill-bid;
- Place bids you do not genuinely intend to honour;
- Interfere with, probe, or disrupt the Auction platform or its security; or
- Impersonate any person or provide false information.
9.1 Breach of this Clause 9 may result in disqualification, reversal of bids, cancellation of a win, and exclusion from current and future Auctions, at our sole discretion.
10. Changes, Suspension & Our Rights
10.1 We may, at our sole discretion and without prior notice, correct errors, void bids affected by technical faults, pause, extend, restart, or cancel an Auction (for example, in the event of a pricing error, technical failure, fraud, or force majeure).
10.2 In the event of a system error, obvious mis-price, or malfunction that affects the outcome, we reserve the right to void the affected bids or the Auction and to refund any amounts collected, as the sole remedy.
10.3 We may amend these Terms at any time. The version published on the Auction page at the time you bid governs your participation.
11. Limitation of Liability
11.1 The Auction platform is provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation and are not liable for bids that fail to register due to connectivity, device, or platform issues.
11.2 To the maximum extent permitted by law, our total liability to any participant arising out of or in connection with an Auction shall not exceed the amount actually paid by that participant for the Item in that Auction.
11.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability under the Consumer Protection Act, 2019.
12. Personal Data
12.1 The name and phone number you provide are collected and used to operate the Auction, notify winners, process rollovers, and complete sales, in accordance with the Sparq / Nuvo Aeon Privacy Policy.
13. Governing Law & Jurisdiction
13.1 These Terms are governed by the laws of India. Subject to applicable consumer-protection law, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with an Auction or these Terms.

14.1 For any question, claim, or grievance relating to an Auction, contact Sparq customer support through the channels listed on the Sparq website. We aim to acknowledge and address grievances within the timelines required under applicable law.
